DRAFT — LEGAL_REVIEW_REQUIRED. This document describes how the Kogoto Creator features actually work and what Kogoto expects from Creators. It has not yet been reviewed by a qualified lawyer and is not a statement that Kogoto or any Creator meets every legal obligation that may apply to them.

These Creator Terms apply in addition to the Kogoto Terms of Service, Privacy Policy and Community Guidelines. If they conflict, the Terms of Service prevail unless these Creator Terms say otherwise for a Creator-specific topic.

1. What a Creator is

A Creator is a Kogoto account holder whom Kogoto has approved to create and manage their own Kogoto Spots and Events through the Creator portal (/creator). A Creator is an independent organizer, business or person, not Kogoto, and does not act on Kogoto's behalf. Kogoto shows the difference between official Kogoto content and Creator content in its own tools.

To use Creator features you need a Kogoto account (you can create one in the Creator portal; it's the same account as in the app) and:

an active Kogoto account with a verified email address;
a Creator application with your last name and/or organization, a phone number and a short description of what you'll run. Kogoto uses the phone number (which it doesn't verify) only to contact you about your application or content; keep it and your other details accurate. Until Kogoto approves the application you can't create Spots or Events, publish posts or send announcements. If Kogoto rejects it, you see the reason and can apply again;
Kogoto's approval (Kogoto may approve, decline, suspend or revoke Creator access at any time under these Terms);
acceptance of the current version of these Creator Terms. Kogoto keeps a record of which version you accepted and when. If these Terms change materially, Creator features stay unavailable until you accept the new version.

2. What Creators can do

Create and edit their own Spots and Events, including a name, description, times, and a logo or image.
Submit that content for review. Every new Creator Spot or Event starts as "pending review" and isn't visible in the Kogoto app — and its QR code and join code don't work — until Kogoto approves it. If Kogoto rejects it, you see the reason, can edit it, and can submit it again. An important edit to approved content (name, description, type, organizer, times, linked Spot, logo, or website/review links) sends it back to review, and it's hidden until approved again. Kogoto may also unpublish, reject, edit or remove content later.
See aggregate statistics for their own content (for example follower, participant and "here now" counts). Creators see individual people only when choosing announcement recipients (section 5), and never anyone's email, phone number or other contact details.
Publish Spot Feed posts in their own approved Spots (see section 5a).
Send Creator Announcements (see section 5).

3. Your responsibilities as a Creator

You are responsible for the content you submit and for the real-world activities you organize. In particular:

Accuracy and legality. Your Spot/Event information (place, times, description, organizer name) must be accurate and not misleading, and both the content and the event itself must comply with the law that applies to you and to the event (for example venue, safety, licensing, age, alcohol, consumer and advertising rules).
Rights to what you upload. You must own, or have permission to use, every logo, image, name and text you upload. By uploading, you confirm that you do, and you grant Kogoto a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and adapt it (for example resize or re-encode it) only as needed to operate, show and promote your Spot/Event within Kogoto, for as long as it's on Kogoto and for a reasonable period afterwards for backups and legal compliance. Real-world organizer responsibility. When you organize an Event or run a place, you remain responsible for it as its organizer or operator. Kogoto doesn't organize, host, supervise or insure Creator events. LEGAL_REVIEW_REQUIRED: liability allocation and consumer-law limits. Nothing in these Terms limits liability that can't be limited by law.
No impersonation or fraud. Don't pretend to be another person, business, brand or Kogoto itself, and don't use Spots, Events or announcements to collect money, credentials or personal data under false pretences.

4. Prohibited content

Everything the Community Guidelines prohibit is also prohibited for Creator content. That includes illegal content; hate, harassment or threats; sexual content involving minors (zero tolerance); non-consensual intimate images; scams, fraud and phishing; spam; dangerous or illegal activities; and content that infringes someone else's rights.

5. Creator Announcements

An announcement is a short message sent inside Kogoto (an in-app announcement, plus a push notification where the recipient allows it). It is not a carrier SMS.
For a Spot you choose the audience of each announcement: people who currently joined the Spot, its followers, or both (each person receives it once). An Event announcement reaches only people who currently joined that Event.
You then choose the recipients: individual people, several people, or everyone eligible. For this you see each eligible person's first name, profile picture and a short identifier (and whether they joined or follow). You may use this only to choose announcement recipients. Don't copy, screenshot, export, store, share or match it with other data, and don't use it to contact, profile or market to people outside Kogoto.
Never eligible: people who left or whose visit expired (unless they follow and you chose followers), people whose account is suspended or unverified, people who blocked you or whom you blocked, and people who turned announcements off. Eligibility is checked at the moment of sending.
Kogoto re-checks every selected person at the moment of sending and skips anyone no longer eligible; each person receives it once. You must confirm every announcement on a summary page before it is sent.
Use announcements for operational information about the Spot or Event (for example schedule changes, entry details, closures, safety information). No advertising for unrelated products, no repeated or bulk messaging, and none of the content prohibited in section 4.
Kogoto limits how often announcements can be sent and keeps a record of every announcement (who sent it, for which Spot/Event, the text, the number of eligible people and of recipients, the audience chosen and when).
Followers chose to follow your Spot, not to receive advertising: follower announcements must stay operational like any other. LEGAL_REVIEW_REQUIRED: whether follower announcements need separate consent or fall under direct-marketing / e-privacy rules.
Users can turn off announcement push notifications in the app's notification settings.

5a. Spot Feed posts

You can write posts (a title, plain text up to 20,000 characters, up to 6 images, and optionally one of your own Events) in Spots you own, save them as drafts, publish, edit, unpublish and delete them. They appear on the Spot page only while the Spot itself is approved.
Posts are plain text: HTML, scripts and formatting aren't supported. You must have the rights to every image you upload (section 3), and everything in section 4 applies to posts.
Publishing a post notifies no one. You can choose "Send as announcement", which goes through section 5 (audience, recipient count, confirmation and limits).
People can like posts. You only ever see the total number of likes, never who liked. People can report posts; Kogoto may hide (with a reason you can see), edit or delete any post.
Kogoto limits how many posts you can create per day.

6. Kogoto's review and moderation

Kogoto may review Creator content before and after publication and may, at its discretion and in line with its Terms of Service and applicable law:

publish, decline to publish, unpublish, or reject content (with a short reason where practical);
hide, disable or remove Spots, Events, images or announcements;
change the owner of content (for example to Kogoto when a Creator account is closed);
suspend or revoke Creator access, or take action on the Kogoto account itself.

Kogoto keeps an internal audit record of important Creator and admin actions. Where the law requires it (for example under the EU Digital Services Act), Kogoto tells you the reason for a restriction and how to contest it. LEGAL_REVIEW_REQUIRED: DSA statement-of-reasons and complaint-handling obligations, and whether Kogoto is a "hosting service" / "online platform" for this feature.

Kogoto's own obligations under the law, including handling notices of illegal content, aren't removed or limited because Creators are responsible for their own content.

7. Reporting

Anyone can report a Spot, Event, announcement or user in the app, or by email to kogoto2026@gmail.com, including notices of illegal content. Reports are confidential: the reported person is never told who reported them.

8. Data

Kogoto processes the information needed to run Creator features: your account and Creator status, your Terms acceptance, the content you submit, aggregate statistics, and the announcement records described above. The Kogoto Privacy Policy explains this in full, including retention and your rights. As a Creator you don't receive other users' personal data from Kogoto.

9. Ending Creator access

You can stop being a Creator at any time by contacting Kogoto. If your account is deleted, your published content may remain on Kogoto as unowned content managed by Kogoto, or be removed, at Kogoto's discretion. LEGAL_REVIEW_REQUIRED: handling of content after account deletion.
